General Terms & Conditions of Business (GTC)

Cancellation costs

In case of cancellation, you must bear the regular costs of return shipping if the delivered product matches the one ordered and the price of the item to be returned does not exceed €40.00, or, if the price of the item is higher, you have not yet passed consideration or made a contractually agreed partial payment, by the time of the cancellation. Otherwise you will not be charged for return shipping.

§ 1 Scope, customer information

The following General Terms & Conditions of Business govern the contractual relationship between Askari Sport GmbH and consumers who purchase goods through our shop. The contractual language is German.

§ 2 Contract

(1) Our offers on the Internet constitute a no-obligation invitation to you to purchase merchandise.

(2) By entering your data and clicking the order button, you make a binding offer to enter into a contract of sale. You may also submit a binding order by telephone or fax. A prompt e-mail or fax confirming receipt of your order does not yet constitute acceptance of your offer to buy.

(3) We are entitled to accept your offer within three days by sending a confirmation of your order by e-mail. If you have not heard from us within this period, your offer is deemed declined, i.e., you are no longer bound by it. If you order by telephone, the contract of sale is formed if we immediately accept your offer. If the offer is not immediately accepted, you are no longer bound by it.

§ 3 Customer information: storage of your order data

We save your order along with the details of the contract entered into (e.g., the product type, price, etc.). We will send you a copy of the GTC, but you may also see them on our website at any time after the contract is made.

As a registered customer, you can access your past orders through the customer login area ("My Askari").

§ 4 Customer information: making corrections

You can use the Delete key to correct your entries at any time before you submit your order. We will inform you of other possibilities for correction as you proceed through the ordering process. You can terminate the ordering process at any time by closing the browser window.

§ 5 Return shipping costs in case of cancellation

In case of cancellation, you must bear the costs of return shipping if the goods delivered match the ones ordered and if the price of the goods to be returned does not exceed €40.00. The same shall apply to higher-priced goods if at the time of cancellation you have not yet passed consideration or made a contractually agreed partial payment. However, you must only bear the ordinary costs of return shipping. We will assume any additional costs incurred as a result of, for example, a change in our place of business or the use of more expensive transport services at our request.

§ 6 Reservation of ownership

The object of purchase remains our property until payment has been made in full.

§ 7 Warranty

The warranty conforms to the provisions of law.

§ 8 Limitation of liability

We assume no liability for breaches of duty resulting from slight negligence unless they concern material contractual duties, damage arising from injury to life, body, or health, or warranties or claims under the German Product Liability Act (Produkthaftungsgesetz). The same applies to breaches of duty by our performing agents or legal representatives. Material contractual duties include, in particular, the duty to transfer possession and ownership of the item to you. Further, we must provide you with the item free of material defects and defects of title.
