Notification of Cancellation Policy

Right of Cancellation

You may cancel your contract within a period of two weeks without stating reasons, either by notifying us in writing (e.g., letter, fax, e-mail) or by returning the goods in question. The cancellation period begins upon receipt of this notification, at the earliest, but does not commence before reception of goods by the recipient nor before we have complied with our duty to provide information pursuant to Section 312c, Subsection 2 of the German Civil Code in conjunction with Section 1, Subsections 1, 2, and 4 of the German Civil Code Information Regulation as well as our obligations under Section 312e, Subsection 1, Sentence 1 of the German Civil Code in conjunction with Section 3 of the German Civil Code Information Regulation. Timely dispatch of the cancellation notice or of the goods suffices to comply with the time limit provided for cancellation. Cancellation notices should be addressed to Askari Sport GmbH, Hans-Böckler-Str. 7, 59348 Lüdinghausen, Germany or, if the goods are returned, to Askari Sport GmbH, Ludwig-Erhard-Str. 1, 59348 Lüdinghausen, Germany.
Packageable merchandise may also be returned by delivering it to a Hermes PaketShop in Germany and Austria, or by having the package picked up by a Hermes employee. For more information, consult our Customer Assistance Department (Phone: +49 - (0) 25 91 - 950 50).

Consequences of Cancellation

In the event of effective cancellation, both parties must restore what has been received in performance of the contract as well as surrendering any benefits (e.g., those derived from use). If you are unable to restore the goods, services and benefits, or if you are only able to restore them in part or in a deteriorated state, you must indemnify us for loss of value. In the case of goods, this does not apply if the deterioration of a good is due exclusively to its examination—such as might have taken place, for example, in a shop. In other cases, you can avoid indemnifying us for loss of value due to deterioration of the good caused by using it for its designated purpose by refraining from using it as you would your own property and by avoiding any other action which might reduce its value. The right of cancellation is not applicable to goods which have been unsealed (e.g., video recordings).

Goods capable of being sent by parcel post shall be returned to us at our risk. You shall bear the cost of return shipping if the goods received are in conformity with those ordered and if the price of the goods to be returned does not exceed €40; the same shall apply to higher- priced goods if at the time of cancellation you have not yet passed consideration or made a partial payment as agreed upon in the contract. In all other cases, you can return the goods free of charge. Goods which cannot be sent by parcel post will be picked up at your address (this clause is applicable in Germany and Great Britain). The obligation to refund payments must be fulfilled within 30 days. For you, this period begins upon posting the declaration of cancellation or the goods; for us, it begins upon their receipt.

Instructions for Processing Returns

For return shipments within Germany and from Austria, use the Hermes parcel service. Please use the following free procedures to return your shipments:

Take the goods to one of the more than 14,000 Hermes PaketShops. Your nearest Hermes PaketShop is listed in the returns form provided with the goods.
In Germany, you can also entrust your return shipments to your Hermes courier.

To ensure smooth processing, please follow the instructions below: Pack the article completely using the original carton. Please do not label or write on the original carton; always leave our address label on the returns package. Fill out the returns form and place it in the package. This will enable us to process all formalities for you quickly and smoothly.

If a messenger service or any other extraordinary means of shipping is used, we can under no circumstances pay any shipping rates higher than those charged by Hermes.

Terms of Delivery and Payment

For shipments within Germany, goods are dispatched ex warehouse at our risk using the Hermes parcel service. Dispatch depends on proper and timely delivery of goods to our own firm; we cannot be held responsible for goods not being available. Indemnification is excluded except in the case of willful action or gross negligence on our part. We reserve the right to make partial deliveries or to combine several orders destined to the same address.

Shipments can be paid for by cash on delivery (COD), credit card, direct debiting or advance bank transfer. We cannot be held liable for the loss of cash. We reserve the right to assess our customers credit worthiness. In order to cover credit risks, we must reserve the right to make fulfillment of your order dependent on advance payment, payment by credit card or COD depending on the results of our credit assessment.

Goods shall only be delivered in amounts typical for a normal household.

Deliveries within Germany
Minimum order value: €25.00
Free postage and packaging for orders of €150.00 and over
Shipping charges in case of payment by credit card or direct debiting or buying on account: €5.95
Surcharge for COD: €3.60 + €2.00 fee charged by carrier upon delivery (Zahlkartengebühr)
If additional shipments are required, no charge shall be made for postage and packaging.
Surcharge for bulky goods: €7.95 (for packages longer than 1.20 m/approx. 3’11”, regardless of order value)
A surcharge will be added for specially-marked items that must be sent via a forwarding agent due to their bulkiness or weight.

Shipping Outside of Germany

The following conditions differ from the above and are applicable to shipments outside of Germany:

Austria:

Minimum order value: €30.00.
Methods of payment: COD, credit card, advance bank transfer or direct debiting.
Postage and packaging in case of payment by credit card or direct debiting or by buying on account: €5.95
Surcharge for COD: €3.60 + €3.50 transfer fee
Free postage and packaging for orders of €150.00 and over
Surcharge for bulky goods: €7.95 (for packages longer than 1.20 m/approx. 3’11”, regardless of order value)

Articles Not in Stock

If an article which has been ordered is not available, we reserve the right to send you a substitute article of comparable price and quality. If you do not wish to accept or keep said article, you may return it to us free of charge. If neither the article you ordered nor a substitute article is available, we shall have the right to refuse delivery. In this case, we shall inform you immediately that the requested article is not available for delivery.

Reservation of Ownership

We shall retain ownership of all goods until they have been paid for in full. Until then you are obliged to treat the goods with reasonable care. In case of delayed payment, we shall have the right to cancel the contract and demand that the goods be returned to us. In case of delayed payment, you must pay the expenses of returning the goods or reimburse them if you have not paid them yourself.

Warranty

The statutory warranty conditions shall apply. If the goods delivered show evident material or manufacturing defects, including damages suffered during transport, please lodge a complaint immediately with us or with the Hermes employee who delivers the goods. Failure to lodge a complaint will in no way affect your legal claims.

Guarantee

We offer a special guarantee of up to 5 years on some items. Each of these items is marked accordingly. Claims made under this guarantee are valid without prejudice to statutory claims/rights.

Prices

Our prices include the Value Added Tax (VAT) prescribed by law. Please note that we can only offer you the stated prices if you place your order on the Internet, since such orders can be processed using less expensive distribution channels. The valid prices for catalog/mail- order and in-shop purchases are cited in the corresponding catalog or shop. All of our offers are subject to confirmation.

The text of the contract is not stored in our system and cannot be retrieved once the order procedure has been completed. However, you can print out your purchase data immediately after placing your order.

All procedures related to data processing (e.g., collection, processing and transmission of data) are carried out in accordance with the corresponding statutory regulations. To the extent necessary, customer data required for business transactions is stored and transferred to service providers contracted by us for the purpose of processing your orders and distributing our promotional messages. We also exchange data with credit-rating agencies for the purpose of carrying out credit assessments and pursuing other legitimate interests.
